Pierre Garcon has decided to file a class action lawsuit against FanDuel on behalf of NFL players for using their names, images and likenesses. This is one of the biggest stories that has come out in the NFL in quite some time, especially with the huge strides that FanDuel has made over the past couple of months.
He talked about why he made the decision to bring this lawsuit to the table against FanDuel.
“I am bringing this lawsuit against FanDuel for using my name, image, and likeness in both daily fantasy contests and through advertising on TV ads and infomercials. FanDuel has taken the liberty to engaged in these actions without my consent and without proper licensing rights. As a result of these activities, FanDuel daily fantasy contests have shown increasing revenues leading to large profits. Therefore, on behalf of myself as well as any other players who are being treated unjustly, I chose to file a complaint.”
Garcon won’t be talking any more about his lawsuit right now while the case is still pending.
“I have been advised by my attorneys not to speak any further on the topic while the case is pending. Any other questions regarding this matter can be addressed to my agent, Brad Cicala.”
Obviously this news is going to be intriguing to follow along with as the case moves forward. Garcon likely has a very good chance to come away with a win in court, as FanDuel has indeed used his image and likeness.
Whether they went through the proper channels or not is another question.
Only time will tell how much this will hurt FanDuel and the daily fantasy football websites that are out there right now. FanDuel is one of the biggest in the game, while DraftKings has also made a huge jump this season.
Expect to hear plenty more news about this situation over the next few weeks as more information becomes available.
